Buyer terms
Terms applying to bidders and successful buyers in sales organised by Arcangelo Auction.
Auction house
ARCANGELO-AUCTION SRL, company and VAT number BE 1021.178.881, Rue Courtois 40, 4000 Liège, Belgium. Contact: arcangelo.auction@gmail.com — +32 496 07 39 67.
Registration and participation
Arcangelo Auction may request information needed to identify a bidder and secure the sale. No deposit is required unless stated before the sale. Participation may be refused for a legitimate reason, including unverifiable identity, a previous payment incident or suspected fraud.
Inspection of lots
Photographs, descriptions, dimensions, estimates and condition information are supplied in good faith. Old or used goods may show wear, restoration, damage or missing parts. Buyers should request a condition report and inspect lots where viewing is available. Mandatory consumer rights remain applicable.
Bids and award
Every bid is binding. The last recognised bidder becomes the buyer when the lot closes. In the event of an immediate dispute, manifest error or technical incident, Arcangelo Auction may reopen bidding or cancel the affected award in accordance with applicable law.
Price and buyer’s premium
The amount due includes the hammer price plus a buyer’s premium of 25% including VAT and any taxes or special charges announced before the sale. No fixed per-lot buyer fee is added. Artist’s resale right is applied where legally due.
Payment
Full payment is due within five calendar days after the sale closes. Cheques are not accepted. Cash is accepted only within the statutory limit, currently 3,000 euros for one transaction or linked transactions. Identification or supporting documents may be requested.
Late or non-payment
A consumer first receives a free reminder and the statutory period of at least fourteen calendar days is observed before any late interest or compensation. Amounts remain limited by Belgian law. Arcangelo Auction may subsequently suspend release, seek payment, terminate the sale or reoffer the lot.
Release and collection
A lot is released only after full payment and must be collected within five calendar days after the sale, unless agreed otherwise in writing. Storage fees may then apply if the rate was disclosed in advance. Transport is at the buyer’s risk from release.
Packing, transport and export
Arcangelo Auction may facilitate packing or contact with a carrier without becoming the carrier. Costs, risks and any import or export permits are the buyer’s responsibility.
Right of withdrawal
No withdrawal right applies where the contract is concluded at a public auction within the legal definition. For an exclusively remote sale outside that definition, the statutory withdrawal period may apply unless another exception applies. More favourable mandatory consumer law prevails.
Data and complaints
Personal data is handled under the privacy policy. Questions and complaints may be sent to arcangelo.auction@gmail.com. Arcangelo Auction favours an amicable solution.
Law and language
Belgian law applies, subject to mandatory consumer rules. This translation is informative; the French version prevails in case of discrepancy, without prejudice to mandatory law.
