- These terms apply to every public auction organised by Arcangelo Auction SRL, rue Courtois 40, 4000 Liège, Belgium, BCE and VAT no. BE 1021.178.881, e-mail arcangelo-auction@gmail.com, telephone +32 496 07 39 67 (the “Auction House”). They are supplemented by the catalogue, auction-specific terms and, where applicable, the terms of an online bidding platform.
- The Auction House may request identification, contact details and any information required for proper conduct of the auction and legal compliance. No security deposit is required to bid. Access may be refused or withdrawn for a legitimate reason, including insufficient information, a previous unpaid balance, identity concerns or suspected fraud.
- Prospective buyers are invited to inspect lots before the auction. Photographs, dimensions, estimates, descriptions, attributions, dates and condition reports are provided in good faith from available information and are for guidance only; they do not constitute an absolute guarantee. Mandatory consumer rights remain unaffected.
- Every bid is binding. The successful bidder is the bidder accepted by the auctioneer or competent officer. In the event of a dispute, error or technical malfunction, reasonable measures may be taken, including reopening the bidding, reoffering the lot or cancelling the award, in accordance with applicable law.
- The amount due comprises the hammer price, announced buyer’s premium, VAT and any expressly notified charges. The buyer’s premium is 25% inclusive of VAT. Bids placed through the “Drouot” platform are subject to an additional 3% “Drouot” platform fee. No fixed fee per lot is charged. VAT is applied according to the regime applicable to the lot and seller. The artist’s resale right is charged whenever legally due.
- Full payment and collection must take place within five days after the close of the auction. All payment methods other than cheques are accepted. Cash payments are accepted only up to the legal maximum of EUR 3,000 per debt or set of related debts, subject to statutory exceptions. The Auction House may require secure payment, proof of identity, proof of source of funds or any legally required verification before releasing a lot.
- In the event of late or non-payment, the Auction House may, where required, give formal notice, withhold delivery, recover reasonable actual costs, seek recovery, cancel the award or reoffer the lot, in accordance with applicable law.
- Ownership and delivery take place after full payment of all sums due, subject to mandatory legal rules. Lots must be collected within five days after the close of the auction, at the place and times notified by the Auction House. Storage charges may be applied after this deadline. Transport risks are governed by applicable law and the carrier’s terms.
- At the buyer’s request, the Auction House may facilitate packing, shipment or contact with a carrier. Unless agreed otherwise in writing, these services are at the buyer’s expense and risk. The buyer is responsible for any export, import or transport formalities.
- Antique, second-hand, art and collectible lots may show wear, restorations, losses, fragility or other signs of age. Regulated goods may be subject to specific formalities or restrictions. Mandatory consumer protection remains applicable where relevant.
- Personal data are processed for registration, auction performance, administration, fraud prevention and legal compliance. Any complaint must be sent in writing within a reasonable time. Belgian law applies; the parties will first seek an amicable solution, and the competent courts are determined by applicable law.
Terms of sale
- These terms govern the relationship between Arcangelo Auction SRL, rue Courtois 40, 4000 Liège, Belgium, BCE and VAT no. BE 1021.178.881, e-mail arcangelo-auction@gmail.com, telephone +32 496 07 39 67 (the “Auction House”) and every seller or consignor. They are supplemented by the consignment form, inventory and auction-specific terms.
- The seller appoints the Auction House to offer the listed goods for public auction, in its own name but on the seller’s behalf, unless agreed otherwise in writing. Acceptance of a lot does not guarantee its inclusion in a specific auction or its sale. The Auction House may refuse or withdraw a lot for a legitimate reason, including doubts concerning authenticity, provenance, value, condition or legal compliance.
- The seller declares that they own the consigned goods or are authorised to sell them; that they are free from third-party claims; and that they have not been acquired unlawfully. The seller must provide accurate information and documents concerning provenance, authenticity, condition, restorations, defects, rights and any restrictions on circulation or export.
- The consignment form records the description, apparent condition, estimate, any reserve price, commission and agreed charges. Estimates and descriptions are made in good faith and are not a guarantee of price, authenticity or outcome. The Auction House may correct or supplement a catalogue entry before the auction.
- The reserve price is set by mutual agreement between the seller and the Auction House and recorded on the consignment form. No lot may be sold below it without the seller’s prior written agreement, unless an expressly accepted special term provides otherwise. The Auction House determines the practical arrangements for the auction, including lot order, grouping, division, withdrawal or reoffering.
- For each sold lot, the seller authorises the Auction House to deduct a commission of 25% inclusive of VAT, plus a fixed fee of EUR 3 per lot. No other sum may be deducted without the seller’s prior written agreement. Statutory charges, including the artist’s resale right where applicable, are handled under the law in force.
- The Auction House takes reasonable conservation and security measures appropriate to the goods. Insurance terms, limits, exclusions, caps and excesses are available to the seller on request. No clause limits liability where Belgian mandatory law prohibits such limitation.
- The seller authorises the Auction House to photograph, film, reproduce and publish the goods and descriptions for preparing, promoting and archiving the auction, including in catalogues, on the website, social media, partner platforms and press communications.
- The seller may not bid, directly or indirectly, on their own lots or manipulate bidding. Any request to withdraw a lot must be made in writing and accepted by the Auction House. No fee or compensation is charged solely because a lot is withdrawn before the auction.
- Unsold lots must be collected by the seller or may, with the seller’s agreement, be reoffered at a later auction or sold privately on agreed terms. No charge is payable by the seller solely because a lot remains unsold, unless agreed otherwise in writing.
- The net proceeds are paid after effective receipt of the buyer’s payment and deduction of the agreed commission, fixed fee and statutory sums, within five days after the close of the auction. In case of buyer default, the Auction House will inform the seller and may, after consultation, seek recovery, reoffer the lot or cancel the award under the applicable terms.
